संविधान तथा संविधानवाद 

- संविधान किसी देश का मूलभूत कानून होता है। इसके विकासक्रम को ऐतिहासिक रूप में बड़े आंदोलनों और क्रांतियों के परिणामस्वरूप देखा गया है। जब कोई क्रिया किसी उद्देश्य को प्राप्त करने के लिए बार-बार दोहराई जाती है तो वह एक प्रवृति बन जाती है।  प्रवृतियां एक पीढ़ी से अन्य पीढ़ियों में संचारित होकर परम्पराओं का रूप लेती है।  परम्पराओं को ठोस स्वरुप देकर जब विधिक मान्यता दी जाती है, तो वह विधान बन जाती है और विभिन्न  विधानों का एक सम्यक स्वरुप संविधान कहलाता है। 

- सामान्य अर्थों में किसी राज्य क्षेत्र में संविधान का अनुपालन करना संविधानवाद को स्थापित करता है।  इसे विधि का शासन या संविधान की सर्वोच्चता जैसे लक्षणों से भी परिभाषित किया जाता है।  संविधान की सर्वोच्चता सुनिश्चित करने के लिए न्यायपालिका की केंद्रीय भूमिका प्रस्तावित हुई है। अतः संविधानवाद न्यायपालिका की इस शक्ति को भी केंद्र में रखता है।  यदि सर्कार ऐसा कोई कृत्य करे जो संविधान सम्मत न हो तो न्यायपालिका संविधानवाद के अनुसार उसे खारिज के सकती है। 

- स्पष्ट है की संविधानवाद एक ऐसी अवधारणा है जो राष्ट्रहित में लोकतांत्रिक मूल्यों की रक्षा के लिए न्यायपालिका की एक प्रभावी भूमिका को स्थापित करती है। 

Constitution and Constitutionalism

- The Constitution is the basic law of a country. Its evolution has historically been seen as a result of major movements and revolutions. When an action is repeated over and over again to achieve a purpose, it becomes a tendency.  Tendencies are transmitted from one generation to other generations and take the form of traditions.  When legal recognition is given by giving concrete shape to traditions, it becomes a legislation and a proper form of various legislations is called the Constitution. 

- In the general sense, complying with the Constitution in a State territory establishes constitutionalism.  It is also defined by characteristics such as the rule of law or the supremacy of the Constitution.  The central role of judiciary has been proposed to ensure supremacy of the Constitution. Therefore, constitutionalism also puts this power of the judiciary at the centre.  If the Government does something which is not constitutional, the Judiciary can reject it according to constitutionalism. 

- Clearly, constitutionalism is a concept that establishes an effective role of the judiciary to protect democratic values in the national interest.
